If you have an online subscription to our hosted job board solution (whether as a paying customer or if you are on a free trial), you will also be subject to our JBIO Master Services Agreement (“MSA”). You and OnCampusNation agree that any arbitration shall be limited to the Dispute between OnCampusNation and you individually. To the full extent permitted by law, (1) no arbitration shall be joined with any other; (2) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (3) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration
You and OnCampusNation agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (1) any Disputes seeking to enforce or protect, or concerning the validity of, any of your or OnCampusNation intellectual property rights; (2) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy or unauthorized use; and (3) any claim for injunctive relief.
30 Day Right to Opt Out of Arbitration
The Website is controlled and operated by OnCampusNation from within the United States of America. OnCampusNation makes no representations that the Website or the materials available via the Website, are appropriate or available for use in locations outside of the United States, Canada, the United Kingdom or the European Economic Area. Those who choose to access the Website from other locations do so on their own initiative and are responsible for compliance with all United States of America laws as well as local laws, if and to the extent local laws are applicable.
